Is the service of applying for a medical cannabis license online legal?

Yes, our service is completely legal. Law 42-2017, authorizes doctors to prescribe Cannabis for medicinal use when treating certain conditions. Law 169-2018 authorizes the use of telemedicine and the online management service with the consent of the patient to process their request on their behalf with the Department of Health.

What is the process to apply for a medical cannabis license?

  1. It starts with you signing up by filling out a short form where your demographic and health-related information is collected.
  2. On that form you also include a photo of your government identification (driver’s license, passport, Real ID, etc.) and a photo of you taken on the phone.
  3. Upon completing the registration, you select your service plan and issue the corresponding payment.
  4. A doctor will contact you for an evaluation.
  5. If qualified, the doctor issues a medical certification recommending the use of Medicinal Cannabis.
  6. With that certification and other documents, you can go to the Puerto Rico Department of Health to request your Medicinal Cannabis license. For a complete list of necessary documents please visit:

  7. If you choose our Medicinal Cannabis License service , we will manage all the necessary documents and money orders in the Department of Health in an expedited manner.
  8. After 24 to 48 hours, you will receive by email your voucher that authorizes you to buy Medicinal Cannabis for 30 days at any dispensary.
  9. At the end of the 30 days, you will receive your official license for the use of Medicinal Cannabis at the dispensary of your choice.

What is a medical certification of a recommendation for the use of Medicinal Cannabis?

After a medical evaluation, if the authorized doctor determines that you suffer from a condition covered by Law 42-2017 and that you would benefit from treatment with Cannabis, he or she will make a written recommendation for the use of Medicinal Cannabis.

This recommendation is NOT a prescription nor does it allow you to buy Medicinal Cannabis from a dispensary.

What evidence do I need of my condition to apply for a medical cannabis license?

The necessary evidence is at the discretion of the doctor evaluating you. During the consultation, the doctor may administer certain tests to help him determine if you qualify. For example, your doctor may administer the GAD-7 test to determine if your anxiety levels qualify you for Medicinal Cannabis use.

Additionally, you can support your condition with some of the following documents:

  • A certification of your condition by your primary doctor or specialist
  • Recent reading of a plate (X-ray, CT-Scan or MRI)
  • Prescription drugs that are not older than 3 months

What happens during the medical evaluation?

During the medical evaluation, the doctor examines your condition or conditions and determines if you qualify for the use of Medicinal Cannabis. Generally, the consultation takes 10 to 15 minutes. Through this evaluation, the doctor and you establish a bona fide Doctor-Patient relationship, as determined by Law 42-2017.

Under no circumstances does License To Toke guarantee that your application will be approved. It depends on the authorized doctor determining that his conditions qualify him for the use of medicinal cannabis.

At the time of being evaluated by the doctor, if during the consultation there is no evidence of suffering from at least one of the conditions approved by the Department of Health, no reimbursement is made.

If you have already been evaluated by a doctor and your case is already filed with the Department of Health, there is no refund. Only specific cases are meticulously reviewed and handled for consideration of possible unsecured credit.

When will your doctor contact me?

How will I receive my MMJ recommendation?

After a period between 24 to 48 hours (* subject to the availability of the Health Department) you will receive by email your voucher valid for 365 days that authorizes you to buy Medicinal Cannabis at any dispensary.

How long does the process take to receive my license for the use of Medicinal Cannabis?

The average time to receive your patient license is 30 days when all documents are submitted manually at the Department of Health

How do you determine the means of consumption of Medicinal Cannabis recommended by your doctor?

The doctor who evaluates you determines the authorized means of consumption according to his condition and severity of said condition presented during his evaluation.

What is the limit on the quantity of Medicinal Cannabis that a dispensary can sell me?

The maximum daily supply limit that can be dispensed to a patient will be one ounce, equivalent to 28 grams of the Medicinal Cannabis flower or its equivalent. According to the new regulation, the ratio of flower to concentrate and edible will be the following:

  • 28 grams of flower will equal eight grams of THC in concentrate
  • 28 grams of flower will equal 800 milligrams of THC in edible

Patients or their authorized companions with a valid and current registration for the use of Medicinal Cannabis may purchase and possess up to a maximum supply of up to 30 days of Medicinal Cannabis at registered and licensed dispensaries.

How do you protect my patient information?

We use the highest standards to ensure the protection of your patient information, including that our entire digital platform is encrypted and protected by SSL, as is all digital communication. We comply with all the requirements of the Health Insurance Transfer and Liability Act known under its acronym HIPPA Act.

Will I be on a government list if I obtain a license to use Medicinal Cannabis?

No. Your profile and record are protected under federal HIPAA law, as are all your documents at any medical office.

What identifications are valid when requesting my license for the consumption of Medicinal Cannabis?

The official identifications used to request your medical cannabis license are the following Real ID, DTOP ID, Driver’s License, or Passport.

The photo must be of your face, from the neck up, looking straight ahead, and with a white background. You must not wear a cap or glasses.

What do I need for my evaluation to obtain the certified medical recommendation?

You need to have completed the registration on our digital platform, selected the service plan, made the payment, your government identification and, if you have it, any evidence that helps support your medical condition that you want to submit.

Where do I send my photo for the Medicinal Cannabis license?

The photo can be uploaded through our digital platform during registration or it can be sent to [email protected] Attached to the photo you must attach your official identification and your social security number.

Do I have to renew my license to use Medicinal Cannabis?

Yes. Patients with a medical cannabis license must submit a renewal application upon the expiration of their license, which can be a period of up to (1) year.

For how long is the certified recommendation, the voucher, and the Medicinal Cannabis license valid?

The certified recommendation for the use of Medicinal Cannabis is valid for (30) days.

The voucher for the use of Medicinal Cannabis is valid and is valid for (30) days.

The license for the use of Medicinal Cannabis is valid for up to (1) year at the discretion of the doctor evaluating you.

Who can recommend the use of Medicinal Cannabis?

Only doctors duly certified with the Puerto Rico Department of Health can recommend the use of Medicinal Cannabis.

To be certified they need:

  • Be licensed to practice medicine in the Commonwealth of Puerto Rico
  • Be licensed to prescribe Classification II controlled drugs in the Commonwealth of Puerto Rico
  • Have completed a training course certified by the Department of Health on Medicinal Cannabis of at least eight (8) contact hours
  • Certified check, manager’s check or money order payable to the Secretary of the Treasury in the amount of $ 1,500.00

Unfortunately, no health plan covers your visit.

Where can I collect my voucher and my license for the use of Medicinal Cannabis?

Your voucher will arrive by email as soon as it is ready.

The Authorized Companion must be:

  • Father, mother, or legal guardian of the minor applicant
  • Over 21 years old
  • Provide an Official State Identification
  • Provide Criminal Record Certification of the Authorized Companion

What are the requirements for a minor to apply for a Medicinal Cannabis license?

Minors must present the following when requesting:

  • Medical evidence
  • 2 medical recommendations by doctors certified in recommending Medicinal Cannabis
  • Letter from both parents or legal guardian authorizing the minor to receive Medicinal Cannabis treatment
  • If one of the parents is absent, produce documents of authority / custody
